While attending a Miami Marlins game against the Atlanta Braves on April 24, 2024, she took part in the team’s popular "Bark in the Park" promotion, an event inviting fans to bring their furry companions to enjoy baseball. However, Hahn's experience ended not with peanuts and Cracker Jack, but with an alleged injury from slipping on dog urine.
From Bark to Lawsuit: Legal Action Against the Marlins
Hahn filed a lawsuit in December 2024 against the Miami Marlins, Marlins Stadium Operator LLC, and the City of Miami. She claims the ballpark was negligent in maintaining a safe environment, alleging that she slipped on a puddle of dog urine that had not been cleaned up. According to the lawsuit, Hahn sustained injuries leading to "pain and suffering, disability, disfigurement, mental anguish," and other damages exceeding $50,000.
The lawsuit further asserts that she fell in an area where dogs were supposedly prohibited, raising questions about stadium policies and enforcement. The Marlins have declined to comment on the pending litigation.
A Risky Ticket: Legal Fine Print Comes into Play
The Marlins' ticket policy includes an "Assumption of Risk" clause, warning attendees that they accept the potential for injury when entering the ballpark. The fine print specifically states that fans "acknowledge and assume all risks and dangers associated" with attending the event.
However, it remains to be seen whether this disclaimer applies to incidents involving dog-related accidents at promotional events. The case will likely examine whether the stadium took adequate precautions to prevent such incidents and whether the assumption of risk extends to slipping hazards caused by pets.
