Taco Bell Sued For False Advertising 5 Popular Menu Items

A dissatisfied customer has filed a proposed class-action suit against Taco Bell, claiming that the restaurant chain deceived its customers by falsely advertising the quantity of ingredients in its Crunchwrap Supreme, Grande Crunchwrap, Vegan Crunchwrap, Mexican Pizza, and Veggie Mexican Pizza. Frank Siragusa, the plaintiff, argued that Taco Bell exaggerated the amount of beef and other components "by at least double," resulting in "unfair and deceptive trade practices."

False Advertising

Siragusa claimed that such false advertising is of particular concern now because of inflation. He argued that low-income customers, drawn by the promise of large portions, may prefer Taco Bell over other restaurants that provide more accurate information about portion sizes.

The lawsuit, filed in the Eastern District of New York District Court, indicates that anyone who purchased any of the items at a New York Taco Bell after July 31, 2020, is eligible to join the class.

Siragusa urged the court to prevent Taco Bell from selling the items unless they revise their advertising and offer full compensation to those who bought the affected menu items from July 31, 2020, to the final judgment.

The Complaint

“Taco Bell advertises larger portions of food to steer consumers to their restaurants for their meals and away from competitors that more fairly advertise the size of their menu items, unfairly diverting millions of dollars in sales that would have gone to competitors,” Siragusa’s team wrote in the complaint.
