You Can Send Your Spouse To Jail For Cheating In Illinois

When it comes to cheating, there is a really big consequence that comes with those actions. The cheater loses all trust in their spouse, there's heartbreak and a strong potential for divorce from your partner. In Illinois, there is a law on the books that could give your cheating spouse a hefty fine and send them straight to jail.

 Can You Throw Your Cheating Spouse In Jail In Illinois?

Some might find it extreme to put their cheating spouses in jail. Those being cheated would probably strongly disagree. Newsweek reports that in the U.S. there are 16 states that have laws on the books making adultery a crime. Illinois is one of the 13 states that consider it a misdemeanor. The other three states say adultery is a felony.

The Illinois Law states that adultery is considered as,

"A person commits adultery when he or she has sexual intercourse with another, not his or her spouse, if the behavior is open and notorious, and: (1) the person is married and knows the other person involved in such intercourse is not his spouse; or (2) the person is not married and knows that the other person involved in such intercourse is married."

Adultery in Illinois is a Class A Misdemeanor. If charged, the cheater could be fined $2,500 and could spend up to a year in jail.

For you cheaters out there shaking in your boots that you might end up in jail for cheating on your spouse, don't worry too much. The last time this was enforced was in 1997. Even the prosecutors were surprised it even worked.
