No Charges Filed After Gun Discharges in Alabama Second Grader’s Backpack
Authorities have announced that no charges will be filed after a gun discharged inside a second grader’s backpack at Challenger Elementary School in Huntsville, Alabama. The incident, which occurred on February 6, led to a police investigation, but officials were unable to determine how the firearm ended up in the child’s possession.
Gun Fired Inside Backpack, Stopped by Laptop
According to Huntsville police, the firearm discharged while inside the young student’s backpack, sending a bullet through the bag and into another student’s backpack. Fortunately, the bullet was stopped by a laptop inside, preventing any injuries. The student whose bag was struck was evaluated by the school nurse and confirmed to be unharmed.
Authorities Unable to Determine How Gun Ended Up in Child’s Possession
During the investigation, police questioned the second grader, who was unable to explain how the firearm got into their backpack. Further inquiries did not yield any answers regarding its origin. The Alabama Department of Human Resources has since been contacted to implement a safety plan and work with the child’s family.
Legal Review Leads to Decision Not to File Charges
On the day of the incident, police initially filed two criminal case reports—one for unlawful possession of a pistol by a minor and another for reckless endangerment. However, after reviewing the case with the Madison County District Attorney’s Office and the Neaves Davis Center, authorities determined that no warrant would be issued against the child. The victim’s family has been referred to the Neaves Davis Center for further assistance regarding the reckless endangerment charge.
